Student Agreement
By signing up as a Student on Apercu Certification & Education (ACE) you agree to the below:
This Agreement (hereinafter referred to as “Agreement”) is made and entered into as of the Effective Date by and between Apercu Certification & Education (ACE), a division of Apercu (Registration Number: K2023950268), located at [Address], (hereinafter referred to as “ACE”), and the Student (hereinafter referred to as “Student”), whose details are specified in the registration process.
WHEREAS, ACE provides a Learning Management System (LMS) to host and manage online courses related to industry-specific certifications and compliance;
WHEREAS, the Student desires to enroll in and participate in courses offered on the ACE platform;
NOW, THEREFORE, in consideration of the mutual covenants and promises herein contained, the Parties hereto agree as follows:
1. Enrollment and Access
(a) The Student shall register on the ACE platform and purchase the desired course(s) through the approved payment methods. (b) Upon successful registration and payment, the Student will be granted access to the course content, including videos, quizzes, assignments, and additional learning resources.
2. Student Responsibilities
(a) The Student agrees to maintain the confidentiality of their login credentials and not share access with any third party. (b) The Student shall complete all coursework, assessments, and quizzes independently unless otherwise specified by the course instructions. (c) The Student shall adhere to all code of conduct and ethical guidelines provided by ACE.
3. Course Content and Certification
(a) All course content is for educational purposes only and may not be reproduced, distributed, or used for commercial purposes without explicit permission from ACE. (b) Upon successful completion of the course and passing the required assessments, the Student will receive a certificate of completion, issued by ACE and/or the affiliated tutor.
4. Payment and Refund Policy
(a) Course fees must be paid in full before access is granted. (b) Refunds are only applicable if the course has not been accessed or completed and must be requested within 7 days of purchase. (c) ACE reserves the right to withhold or revoke certification if fraudulent activity or cheating is detected.
5. Intellectual Property
(a) All content on the ACE platform, including course materials, videos, and quizzes, is protected by intellectual property laws and remains the property of ACE and/or the respective tutor. (b) Students are not permitted to download, share, or distribute course content without explicit permission from ACE.
6. Platform Maintenance and Availability
(a) ACE will make every reasonable effort to maintain platform availability. However, ACE is not liable for interruptions due to maintenance, updates, or unforeseen technical issues. (b) In the event of a platform outage, ACE will inform students of the expected resolution time and provide alternative access where possible.
7. Code of Conduct
(a) Students are expected to maintain respectful and professional behavior when interacting with tutors, peers, or ACE staff. (b) Disruptive, discriminatory, or inappropriate behavior will result in suspension or termination of access without a refund.
8. Liability and Disclaimers
(a) ACE does not guarantee employment or certification acceptance by third parties upon completion of any course. (b) The Student acknowledges that course content is for educational purposes only and should not replace professional advice or official certification requirements unless explicitly stated.
9. Termination
(a) ACE reserves the right to terminate this Agreement and revoke platform access for any breach of the terms outlined herein. (b) The Student may terminate their enrollment at any time, but no refunds will be issued if the course has been accessed.
10. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of The Republic of South Africa.
